The dispute resolution team is led by Toby Starr.
The team specialises in complex dispute resolution through English court litigation, domestic and international arbitration, negotiated settlements and other processes in the UK and worldwide.
We advise on English contract and tort law and English High Court, arbitral and other specialist tribunal procedures as well as the procedures of ICSID, the ICC, the LCIA, LMAA and UNCITRAL and ad hoc arbitrations.
In the last three years we have:
- won both of our High Court trials, in complex, high value litigation in which Toby Starr appeared as an advocate
- won final awards in arbitration
- won judgment in English County Court litigation and in hearings before Employment Tribunals and the Employment Appeal Tribunal
- successfully settled litigation involving financial derivatives, banking and private equity interests
- handled applications before the English Commercial Court in support of foreign arbitral proceedings
- advised in ongoing investor-state arbitration proceedings at ICSID
- represented commercial and private parties in arbitrations
- advised on an ICC arbitration
- advised in relation to and/or obtained damages and injunctions or undertakings (including freezing injunctions and a search order), resisted injunctions and an application to commit for contempt
- advised on the disapplication of restrictions on use of documents obtained in the course of proceedings, on ‘Three Rivers’ rules in a complex international disclosure dispute and on English rules as to separate corporate personality/ alter ego in relation to companies.
- represented clients for warranty claims, online defamation claims, breach of fiduciary duty, breach of contract and other claims in the High Court
The clients of the dispute resolution team include corporates in the aviation, banking and financial services, construction, healthcare, IT, private equity, sports and leisure, pharmaceutical and retail sectors.
